Licensing and Use
Commercial | Educational
| Personal | Storm Video
NOTICE .. Any duplication, electronic
or otherwise, of the images at this Website without my expressed
permission is a copyright violation, and I will treat it
as such. Do us both a favor and ask me for permission before
using any of the images herein ... you can e-mail me at
cdoswell@earthlink.net.
NOTICE .. All images I show on my Web
pages have been scanned from original film, with some digital
enhancement (touch-ups of dirt on the slides when scanned,
and some enhancement of the scanned images to make them
look more like the original film shots). I do not alter
my images digitally to put in things that were not originally
in the image or remove things that were originally in the
image, and I do not make digital composites. I am personally
opposed to such image manipulations unless they are admitted
to clearly and obviously.
Commercial Use
My images can be licensed for commercial uses, either advertising
or editorial. I follow the stock photo pricing guidelines
developed by Jim Pickerell, as a starting point for negotiating.
If we are going to negotiate a price, I need to know some
specifics about an intended use: size of the image as used
(in terms of a fraction of a page), the print run (for books),
the size of the circulation (for magazines), and so forth.
The pricing depends on a number of factors, as is typical
for buying stock photography.
I will provide high-resolution digital
images to fulfill image licensing requests. I don't release
my film originals to anyone, at any time, for any purpose
... too many bad experiences. If you must have film, I will
arrange for duplication of my originals, and the my cost
of duplication will be included in the price.
Scientific
and Educational Use
In situations where the intended use of the image is scientific
and/or educational, with no commercial intent, I can grant
permission for specific uses free of charge. The terms for
this are the same as for personal use, described below.
You must contact me and agree in writing (or by e-mail)
to abide by my terms. Unauthorized scientific and/or educational
use will be considered a copyright violation.
See here for details
about free usage.
Regarding the use of my
tutorials about photography: brief excerpts without
images can be used in educational materials without a fee
if the source is properly cited. Reproduction of images
or extensive replication of the contents of my tutorials
in the production of educational materials is not permitted
without a licensing fee, unless the producer is not being
paid to teach. If the producer of educational materials
is being paid for teaching, then any use other than brief
excerpts of my materials in educational materials requires
a license fee. If I incur any costs (e.g., duplication,
mailing, long-distance phone calls, etc.) associated with
such uses, in general I will expect to be reimbursed for
these costs.
Storm Video
Generally speaking, any videos I am selling for commercial
use are of tornadoes and severe thunderstorms. Anyone interested
in my videos should work with my video stock agency, Prairie
Pictures, also known as Storm
Stock. The main item of interest in my video collection
is a rather spectacular video of the debris-filled tornado
in Pampa, Texas on 08 June 1995. See
here for more details.
Personal Use
Generally speaking, I do not sell images for personal use.
However, I am willing to grant permission for limited types
of personal use, notably digital images associated with
personal computers (e.g., "wallpaper" or backdrops
for personal, noncommercial homepages). Downloading digital
image files onto your computer for such personal uses may
be possible without charge, provided you agree to do all
of the following:
Contact
me to ask for permission.
Do your best to prevent unauthorized duplication of the
files. The more copies of an image that float about, the
more likely a copyright violation becomes, in spite of good
intentions. Copies made for your friends without their obtaining
permission from me directly is considered a copyright violation.
Proper copyright notice needs to be displayed with any electronic
use of the image. In most electronic versions of my images,
such a copyright notice is already provided directly on
the image itself. Removing this notice will be considered
prima facie evidence of a copyright violation unless you
display it elsewhere in direct association with the image.
Whenever you are done using the downloaded image, you will
delete it (and any copies) from your system. Also, if any
hard copies were made at any time, you will destroy them
after any authorized uses. No exceptions to this policy
are allowed.
I must have it in writing (or by e-mail) that you agree
to the preceding conditions for free personal use.
